TERMS AND CONDITIONS

Water Sports Activities

1. General

These Terms and Conditions apply to all participants engaging in water sports activities provided by “Central Watersports Kardamena”. By booking or participating in any activity, participants confirm that they have read, understood, and agreed to be bound by these Terms and Conditions.

2. Booking & Payment

Bookings must be made in advance, either online, by phone, or via email.

For activity bookings made at least fifteen (15) days in advance, a deposit is required to secure the reservation. The deposit amount will be communicated during the booking process.

Depending on the activity and booking period, either a deposit or full payment may be required to confirm a booking.

Payments can be made in cash, via bank transfer (IBAN), or through PayPal.

Cancellations made up to seventy-two (72) hours prior to the scheduled activity are eligible for a refund of the deposit.
Cancellations made less than 72 hours before the activity, no-shows, or early termination due to participant behavior are non-refundable.

All cancellation policies and any applicable fees will be clearly communicated at the time of booking.

3. Eligibility & Health

Participants confirm that:
• They are in good physical and mental health.
• They have no medical conditions that could affect their ability to safely participate.
• They are not under the influence of alcohol, drugs, or medication that may impair judgment or physical ability.
• Minors may only participate with written consent from a parent or legal guardian.

4. Pregnancy Restriction

Participation in water sports activities is strictly prohibited for pregnant women, without exception, for safety reasons.

5. Safety Instructions

Participants must strictly follow all safety instructions and guidance provided by staff at all times.

Life jackets and any required safety equipment must be worn as instructed. Failure to comply with safety rules may result in immediate termination of the activity without refund.

6. Assumption of Risk

Participants acknowledge that water sports activities involve inherent risks, including but not limited to injury, drowning, equipment malfunction, collisions, and changing weather or sea conditions.

Participation is entirely at the participant’s own risk.

7. Insurance Coverage

All participants of “Central Watersports Kardamena” are covered by insurance for:
• Personal injury or death of the participant, and
• Liability for bodily injury or death of third parties,

in accordance with applicable Greek law and the terms of the company’s insurance policy.

Insurance coverage does not extend beyond the scope defined by the insurer and does not cover incidents arising from non-compliance with safety instructions or these Terms and Conditions.

8. Liability Waiver

To the fullest extent permitted by law, “Central Watersports Kardamena”, its owners, employees, and affiliates shall not be held liable for any personal injury, death, or loss or damage to personal property arising from participation in any water sports activity, except in cases of gross negligence or willful misconduct.

9. Personal Belongings

Participants are solely responsible for their personal belongings.

“Central Watersports Kardamena” shall not be held liable for any personal items that are lost, stolen, or damaged before, during, or after participation in any water sports activity. Participants are strongly advised not to bring valuable items with them during activities.

10. Equipment Use & Damage

All equipment must be used responsibly and only for its intended purpose.

Participants are financially responsible for any damage or loss of equipment caused by misuse, negligence, or failure to follow instructions.

11. Weather & Sea Conditions

All activities are subject to weather and sea conditions.

“Central Watersports Kardamena” reserves the right to cancel, postpone, or modify any activity for safety reasons. In such cases, rescheduling or refunds will be handled at the company’s discretion.

12. Personal Data & Privacy (GDPR Compliance – Greece & EU)

“Central Watersports Kardamena” collects and processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and applicable Greek data protection laws.

Personal data is collected solely for legitimate purposes, including:
• Booking management and customer identification
• Safety and operational requirements
• Compliance with legal and regulatory obligations

Personal data may include full name, contact details, date of birth, identification details, and emergency contact information.

All personal data is stored securely and accessed only by authorized personnel. Personal data will not be shared with third parties, except where required by law, for safety reasons, or when necessary to complete a booking or payment process.

Personal data is retained only for the period necessary to fulfill the purposes for which it was collected or as required by law.

Participants have the right to access, correct, or request deletion of their personal data, in accordance with GDPR. Requests may be submitted in writing to centralwatersportskardamena@gmail.com.

13. Photography & Media Use

During activities, photographs and video recordings may be taken for operational, safety, and promotional purposes.

By participating in any water sports activity, participants explicitly consent to the use of such photographs and video material for advertising, marketing, website content, and social media promotion of “Central Watersports Kardamena”, without compensation.

Participants who do not wish to appear in promotional material must inform the company in writing prior to the activity.

14. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Greece and applicable European Union regulations.

15. Acceptance

By making a booking or participating in any water sports activity, the participant confirms full acceptance of these Terms and Conditions, including insurance, personal belongings, data protection, and photography provisions.
